Impact Fee Fact Sheet

This fact sheet has been prepared to provide answers to commonly asked questions about these fees. Additional information may be obtained by contacting the Marion county impact fee Office at (352) 438-2610.

On September 26, 1989, the Marion county Board of county Commissioners adopted Ordinance 89-27, which established impact fees for transportation facilities. The impact fee became effective on January 1, 1990. Since initial adoption the ordinance has been updated twice, with the most recent update being Ordinance 02-08.

WHAT IS THE PURPOSE OF THE TRANSPORTATION IMPACT FEE?

The rapid rate of new development within the county will require a substantial increase in the capacity of public roads. The purpose of the impact fee is to ensure that new developments will pay their fair share of the cost of providing these facilities. The impact fee is designed to collect the difference between the cost of the new roads attributable to new development and the amount of gas tax revenues which the new development will produce for the County to use in road construction.

WHO MUST PAY THE IMPACT FEE?

After the effective date of the ordinance, an impact fee must be paid for any new development which generates additional traffic. The categories of land development activities which are subject to the fees are listed in the fee schedule that is available at the Impact Fee Office (located within the Building Department). The impact fee must be paid for new development in both the unincorporated and the incorporated areas of the county.

WHEN MUST THE IMPACT FEE BE PAID?

The impact fee must be paid before a Certificate of Occupancy is issued by the Building Department. No temporary or permanent Certificate of Occupancy or clearance for establishing permanent electrical power shall be issued until the applicable impact fee has been paid.

WHAT WILL THE FEES BE USED FOR?

The impact fees will be used to help pay the costs associated with increasing the capacity of Arterial and Collector roads, which are the major roads within the network in the County. This may include the addition of lanes to existing roads, to increase volume of traffic and the creation of new roads. Impact fees will not be used for routine maintenance on existing roads or for improvements to local roads, such as minor streets within subdivisions.

WHERE WILL THE FEES BE SPENT?

At the present time, the County has been divided into four construction roads districts. The boundaries to the north are U.S.441 and S.R.40. The boundaries to the south are U.S.301 and S.R.40. Impact fees will be expended in the district in which they are collected.

MOBILE HOMES

Certificates of payment were issued to all mobile homes from January 1990 to December 5, 1994. Since December 5, 1994, impact fees paid on mobile homes remain with the land. On June 1, 2002, all certificates of payment that have not been surrendered to the County Administrator or his designee for intradistrict relocation shall expire and shall remain and run with the land for which the certificate of payment was issued.
