1.What are the
setbacks for a house? What about an accessory?
The setbacks are determined by the zoning classification of the property. If
you already know the zoning classification of your land, you can look up the
setbacks and permitted uses in the Marion County Land Development Code. Click on
the Land Development Code link in the right-hand column. If you are unsure what
the zoning classification is of your land, give our office a call.
2.What are the permitted
uses?
If you know the zoning classification of
your land, you can look up the approved land uses in the Marion County Land
Development Code. Click on the Land Development Code link in the right-hand
column.
3.Do I need a permit
for a shed?
Yes, you will need to apply for a permit
for a shed. You can apply for a permit by using the permit application found
on the Building Department homepage. Or you can visit the Growth Management
Bureau building and apply for a permit in person.
4.Is my property in
the flood zone?
You need to call our office for a flood
determination. If your parcel is located in the 100-year flood plain, you
need to obtain an elevation survey. Your structure must be built [1]-foot
above the base flood elevation.
5. Do I need a
permit for a fence?
No, Marion County does not have a fence
ordinance. However, if you are building a concrete wall you will need a
permit.
6. Do I need a
permit to cut down trees on my property?
A permit is needed to cut down trees on
any COMMERCIAL property. Call or visit our office for more information.
7.Can I divide my
property?
Call us so we can help you make this
determination. Before you call, have all of the property identification
information available.
8.Is my property
eligible for a family division?
If your property is a parcel of record
as of January 1, 1992, it may be eligible for a family division. Call us and
we’ll check on it for you.
9.I own
property. How can I change the zoning to commercial?
You need to check with the Planning
Department to find out the Land Use of your parcel. If you have a Commercial
Land Use, you may apply with the Zoning Department to change the zoning to a
commercial designation. If not, you need to apply for a Land Use Amendment
through the Planning Department first.
10. Do I need a
building permit for an agricultural building?
You can apply for a non-residential farm
building review with us. The first thing we will need to confirm is that the
structure will only be used for agricultural purposes. The cost for a
non-residential farm building review is a $20.00. Call the Zoning Department

11.How many dogs can
I have on my property?
Marion County does not impose a limit on
the number of dogs you can have. If you groom, breed, raise, board, or train
animals for income you will need to apply for a Special Use Permit for the
purpose of a kennel.
